Commitment to Data Privacy

At Wayground, we take data privacy very seriously. We adhere to federal safety and privacy legislation such as the Family Educational Rights and Privacy Act (FERPA) and the Children's Online Privacy Protection Act (COPPA).

Additionally, we are proud members of the School Data Privacy Consortium (SDPC) and Access 4 Learning (A4L) Community, which signifies our commitment to upholding high standards of data privacy in education.

While we strive to accommodate as many state and district-specific data privacy requirements as we can, as a small team, we may not be able to respond immediately to every request. Nonetheless, we do our best to support your district and provide resources for some of the most common state-based requests.

Understanding Your Next Steps

This table includes all 50 states in the U.S., outlining the best next step for each state to ensure data privacy compliance when using Wayground. If you're a district administrator, please refer to your respective state in the table below and follow the suggested action. This could be requesting an Approved Data Processing Agreement (DPA), signing an Exhibit E, or signing the Student Data Privacy Agreement (SDPA). As explained in the subsequent section, these actions are critical in aligning with state-specific data privacy requirements and ensuring a secure digital learning environment for students.

Request Approved DPA: If your state is listed with this next step, it means that you should request the National Data Processing Agreement (NDPA) that has been approved as compliant. This is a legally binding document that outlines the responsibilities and obligations of both parties (in this case, Wayground and your district) with respect to the protection of student data.

Sign SDPA: This means that you should sign the Student Data Privacy Agreement (SDPA) that has been approved for your state. This is a document that is used by the SDPC to ensure that all of their members are adhering to the same high standards of data privacy. This document details any specific requirements or provisions that your state has in place for the protection of personal data. You would become the ‘originator’

Sign Exhibit E: If your state is listed with this next step, it means that you should sign Exhibit E, which is a specific part of the DPA that has been customized for your state and already been signed by another district as part of the original SDPA. In this instance, you would become a ‘subscriber’.
